Arthur PETIOT, sole trader operating under the business name ATUDEV - 4 rue de la Convention, 42100 Saint-Étienne, France. SIRET 842 281 446 00026. VAT not applicable, article 293 B of the French tax code.

Purpose

These terms govern the use of the Cadence app and of the Cadence Pro subscription. Installing the app constitutes acceptance.

You are granted a personal, non-exclusive and non-transferable right to use the app, on the devices attached to your Apple ID. That right is not an assignment: the app and its content remain the property of their author.

Free version and Cadence Pro

The app is free and lets you keep three workouts, with no time limit and no advertising. Cadence Pro removes that limit.

Payment and refunds

The subscription is sold and billed by Apple through your App Store account. We collect nothing directly and have access to no payment data.

Refund requests therefore go to Apple, through the “Report a Problem” page of Apple Support. As the subscription covers digital content supplied immediately, the fourteen-day right of withdrawal no longer applies once access is open, in accordance with article L221-28 of the French consumer code.

Your data

The app collects no data and connects to no server. The details are in the privacy policy.

Sporting use

Cadence may suggest workouts made up of bodyweight exercises, or of exercises using the equipment you have declared, purely for guidance. These suggestions are generated automatically, on your device, from the date or from the muscle groups, duration and intensity you specify. They constitute neither medical advice, nor a programme drawn up by a health professional, nor personalised coaching: they take no account of your state of health, of any injuries, or of your actual level. You remain the sole judge of the exercises you perform, of their intensity and of your ability to carry them out. If in doubt, in pain, living with a medical condition, or returning after a long break, seek a doctor’s advice before training.

Availability and liability

The app is provided as is. We strive to keep it working properly but guarantee neither the absence of defects nor compatibility with every future version of iOS. Our liability cannot exceed the amount you paid for the subscription over the last twelve months. The statutory warranties of conformity and against hidden defects remain, however, fully owed.

Changes to these terms

These terms may change; the applicable version is the one published on this page, with its revision date. A substantial change applies to a running subscription only at its renewal.

Governing law

French law. In the event of a dispute, an amicable solution will be sought before any action; consumers may refer the matter free of charge to a consumer mediator.
